Open Funk UG (haftungsbeschränkt) limited warranty
We are Open Funk UG (haftungsbeschränkt), a company incorporated under the laws of Germany, whose address is c/o MotionLab ML GmbH, Bouchéstrasse 12, Hall 20, 12435 Berlin, Germany and email hello@openfunk.co ("Open Funk”, "we", "us"). By purchasing your Open Funk product, you also benefit from the terms of the Open Funk Limited Warranty ("Warranty") below.
Definition
This Warranty reflects a commercial warranty offered by us to our UK, EU and CH customers. This Warranty is separate from, applies in addition to, and does not in any way affect your legal consumer rights, including your free of charge statutory warranty rights in relation to faulty or misdescribed Products (and in France those in relation to the conformity guarantee or the guarantee for hidden defects, as detailed in the Guarantee section of the Terms of Sale accessible here).
Scope
This Warranty applies to Open Funk-branded products purchased from Open Funk or an authorized reseller, and applies only in the countries to which Open Funk ships and supports: https://support.openfunk.co/en/articles/8890107-what-countries-do-you-ship-to
Duration
Open Funk warrants that Open Funk branded products, parts, and modules ("Product") when used in accordance with Open Funk documentation and guidance, are and will be free from defects in materials and workmanship for a period of 2 years from the date of delivery of the Product (the “Warranty Period”). If a different Warranty Period is specified in the order confirmation or invoice of the Product, that Warranty Period shall apply.
When you file a request for repair or replacement that complies with the Limited Warranty, then the Limited Warranty period is suspended. The suspension period is defined as the following:
- Start: the day that you file a request to Open Funk
- End: the day Open Funk delivers the repaired or replaced Product or replacement parts or modules to you.
The Limited Warranty period is also suspended if you and Open Funk amicably negotiate in order to settle an issue on the defect.
The Warranty is free of charge.
Method of Warranty
To submit a Warranty claim, contact Open Funk Support at hello@openfunk.co, mentioning your order number.
If the Product has a defect or malfunction that is covered under the Warranty, we will determine in our sole discretion whether to repair, replace, or refund the Product to resolve the issue.
If possible, Open Funk will provide replacement parts or modules and repair guides to enable you to self-service your Product. Open Funk is not responsible for any labour or equipment costs you incur self-servicing your repair. In some cases, Open Funk may determine that a full Product replacement is required. The replacement Product, parts, or modules may be new or refurbished items that are equivalent in performance and reliability to the original.
If Open Funk determines that a Product, part, or module needs to be replaced, we will provide instructions for return of the replaced item, and we will cover the costs of return. Open Funk may require a credit card authorization for the retail price of the replacement item, which is released when Open Funk receives the replaced item back. If Open Funk does not receive the replaced item back as instructed or the replaced item is ineligible for Warranty service, Open Funk will charge your card for the authorized amount.
If Open Funk determines a full unit repair is required rather than field replacement, we will provide a prepaid mailing label and, if necessary, packaging material and instructions. Open Funk will perform repair on the Product, or, if necessary, issue an equivalent replacement Product.
All replaced Open Funk Products become Open Funk’s property.
Any Product repaired or replaced under this Warranty will continue to be covered by the Warranty for the greater of the remainder of the original Warranty period or (90) days following your receipt of the repaired or replacement Product.
Limitations
This Warranty does not apply to:
- Normal wear and tear.
- Cosmetic issues that do not impact product functionality.
- Damage caused by misuse, accident, neglect, or abuse.
- Damage caused by repair that does not follow Open Funk-published repair guides.
- Damage caused by third-party parts or modules not tested and certified by Open Funk.
- Open Funk-branded products and parts purchased from unauthorized sources.
- Non-Open Funk-branded products or parts. Third-party manufacturers and sellers may provide their own warranties.
Prototypes, samples, and products or parts sold without commercial warranty are not covered by the Warranty.
No Open Funk employee, reseller, or other agent is authorized to make any modification, extension, or addition to this Warranty. If any term in this Warranty is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired, except if the essential terms of this Warranty are affected.
